Won't stop me from buying it or using it on the highway, just curious.
I assume it's smog/emission related.

They may not have gone through the expense of getting CARB approval, as noted, but I bet it still passes the sniffer.
My Expy has a CARB-approved Procharger, but non-approved fuel system mods, custom tune, and two missing pre-cats. I easily passed the sniffer.
My VW has a lot of non-approved upgrades (bigger turbo, aftermarket tune) and these mods have easily passed the sniffer on other cars (mine hasn't had to get smogged yet, but I know guys who have passed with identical mods).
IMHO a well-maintained, well-running modern EFI car will pass the sniffer, even with significant mods. You run into trouble with too-rich AF ratios,no cats and high NOX if you have no EGR, but a good tune should be pretty clean so far as exhaust is concerned.
