How about a gray area scenario where you have an aftermarket part like say a rear diff. cover which the dealer installs at a fluid change and they forget to add LS modifier and the clutches go. Is there any black and white rule that covers something like that?

I would imagine that if you had no documentation that the LS modifier was in fact added the to diff fluid, you'd be screwed regardless of whether or not you changed the cover. I have heard instances of dealers trying to void warranties in such situations where the cover was changed or when switching to a Mag-Hytec tranny pan, but I don't know if they were ever confirmed.

The fact remains that there needs to be substantial proof that the object in question is the CAUSE of the failure. If the service was done properly (and the modifier WAS added... and documented) I'd love to see the dealer prove that a differential cover caused the problem. Unfortunately, the ensuing legal battle would be costly and it would be a moral victory at best. Maybe enough moral victories is what it takes. I wish I had an answer...

Take care.

well i'm glad i started a good topic and i think i'm gunna just get exhaust and a CAI. that seems to be safer. I would hate to buy a tuner and have something related break, then i'd be screwed.
Thanks for all the good info.

I waited till my warranty was almost up, 31,000 miles on it. Couldn't wait any longer. Wish now I had done it sooner.

You seem to have missed the point - nothing is really safe - if they choose to, they can cause you grief upon seeing that CAI.

At least with a tuner you can remove it. ( Sorry, Q, lol)

As for breakage, a properly written tune will not break anything.

Yep, I can hear it now. That intake added 5 to 10 HP which put more stress on the power train resulting in you blowing out the gears in the rear end. Warranty Void!

With some of the hp claims out there I wouldn't be suprised.......

ASE, sorry to ask a question with no real answer, I believe that falls back into the realm of what has already been established as "depends on the dealer".

BlackDawg,

I always like to engage in discussions that help educate the general public. As you said, there is no black and white on this issue and it does end up depending on the dealer when it comes to dealing with a fair resolution to warranty claims. As long as someone can read this thread and walk away with sufficient knowledge to make an educated decision, then we are all winners.

Later.
