That is just simply the nature of an open differential, whichever wheel has the least resistance will be the wheel to receive the power. It is a fair setup for mild to moderate off road adventures but for the real tough terrain a traction adding differential( ARB air locker,Detroit locker, Tracloc ect ect ect) can mean the difference between making it through or hanging it up.
If you had a broken spider upon engagement of the 4wd you would most likely hear a nasty grinding, or there would simply not be any power to the ground through the front axle.
