The proper way to measure used tires with a depth gauge?

I know nobody here messes around with used tires but I have a question related. If a tire comes new with 13/64 inch tread and a tire dealer is selling a set of used that he claims has 9/32 depth, where is that measured?
Is the honest way to measure between the treads at various points across the face, or does he measure only in one spot near center?
I'm thinking a 9/32 depth in the center could be wore down to the wear bars on the shoulders.
